NSA Against Law Students : In a major development bringing relief to law students across Madhya Pradesh, the High Court has ordered a ban on invoking the National Security Act (NSA) against several students involved in recent protest activities. The court strongly criticized the police for the “unwarranted and disproportionate” use of NSA provisions, calling for immediate release of detained individuals and accountability from law enforcement officials.

Background of the Case

The incident stems from a recent protest led by law students over alleged irregularities in examination schedules and internal university policies at multiple law institutions in the state. The protests, which remained largely peaceful, turned confrontational at a few locations, prompting police action. Several students were detained, and in a surprising escalation, the NSA was invoked against a few key participants, allowing the authorities to hold them without bail or formal charges for up to 12 months.

The action drew strong criticism from legal experts, student bodies, and human rights groups, who termed it “a misuse of power” and “an attempt to stifle academic dissent.”

High Court Intervention

Hearing a series of petitions filed by student representatives and civil liberties organizations, the Madhya Pradesh High Court observed that the application of the NSA was “excessive and legally untenable.” The court remarked that expressing grievances, especially in an academic context, is protected under constitutional rights to free speech and peaceful assembly.

The bench added that law students, being future officers of the court, must be encouraged to engage with legal systems, not punished for questioning them. The court also pointed out procedural lapses in the way detentions were carried out and questioned the absence of prior warnings or mediatory attempts by the police.

Police Reprimanded, Students Released

In a sharp rebuke to the state’s law enforcement, the court directed the immediate revocation of NSA orders and release of all affected students. It also ordered the Director General of Police (DGP) to conduct an internal inquiry and submit a report on the use of excessive authority in the matter.

The court concluded by emphasizing that disagreement with university policies does not equate to a threat to national security, and warned against normalizing the use of draconian laws in civil matters.
